ODR Resolution Center is supposed to be an e-court or it is deemed to be a virtual courtroom. This e-court provides video conferencing integrated, as well as document management, scheduling, and more.
Once you confront issues or conflicts with anybody and you have decided to resolve the issue by means of online dispute resolution, you are almost there to face a smooth and tension free process online. You simply register the case free of cost and file the required documents. You need not confront the opposing party, experience speedy resolutions or even a settlement within one or two hours.

Architecture

The architecture is being adopted for the purpose of online Dispute Resolution. PC, MAC is being preferred. The disputing parties and the nominated Mediator or Arbitrator have to share their respective ids each other for the procedure being managed by MEDIATOR AFFAIR. If any new party to get into the proceedings he/she also has to share their respective ids with other participants of the proceedings.
In the Mobile Applications, PC or MAC at the presiding side and the parties shall have smartphones or tablets with Android or IOS operating systems. If required appropriate software has to be incorporated to meet the concerned obligations.

Payment Options

Clients have to pay one-hour fees in advance prior to resolution. If a resolution process exceeds by the beginning of every hour you either make the payment (in case of hourly fees) by Bank Transfer or Debit or Credit Card. There will be a 5 to 10 minutes break after every hour. If the tariff is based on slab system like Arbitration, half of the fees shall be made in advance prior to the commencement of resolutions and half of the fees as suggested by the Administrator or Registrar in between.

Resolution Process

The disputants may be vested with their respective conferred ids automatically got shared with Resolution Center. The nominated Arbitrator or Mediator who also possesses their respective ids shall be shared with disputants so that the pre-resolution process and post-resolution process can be carried out at the convenience of the participants of the process. A pre-resolution process in the form of conference will be the first step in the process and the schedule of dates and times of the dispute resolution process will be finalized in the conference.

The documents and other papers can be transferred by means of MEDIATOR AFFAIR software which further facilitates emails, instant messages, etc.

Exchange of Documents

The Resolution Centre provides series of forms (exclusively for the easy facilitation of the issue framing and diagnosis) supposed to be filled by the plaintiff and respondent separately which have to be submitted or sent to the Mediator/Arbitrator using MEDIATOR AFFAIR or by email (the respective id has to obtained from the Mediator/Arbitrator during the initial conference and parties’ email id vice versa) prior to the process. During the resolution process, if the mediator/arbitrator requires or demands any particular documents to be prepared to the effect of Resolution, the disputing parties have to comply with such demands with an immediate effect either by quick message sending mechanisms like MEDIATOR AFFAIR or by emails.

E- RESOLUTION -

  • Primary Evaluation - (Nominated Mediator/Arbitrator summons Parties to the dispute for separate discussion to the effect of Terms of Reference, Scheduling times and dates for the process of e-resolutions.)

Assignment of an Arbitrator or Mediator – This is a session where clients are supposed to meet the Registrar or Case Administrator to the effect of choosing or getting assigned with the services of an Arbitrator or Mediator from among the panel of the institutions with which AMA has associated with. For General Mediation and Online Counseling clients can resort to the exclusive panel accredited mediators of AMA

Once the Arbitrator or Mediator is assigned with respective services, the clients are directed to meet the respective Arbitrator or Mediator.

Initial Hearing - The initial hearing, which typically takes place shortly after the assignment of the arbitrator or mediator or the respective institution, results in a comprehensive plan for the proceedings along with the respective significant issues that may be decided. These are styled in a Terms of Reference fashion.

The initial hearing and first procedural order typically address such issues as:

  • Scheduling the time, determining the language and applicable law of the arbitration if required, if these have not previously been determined

  • Requests for interim measures, bifurcation or confidentiality

  • Extent and timing of exchange of documents, and method for resolving disputes regarding document exchange

  • Number and form of written and evidentiary submissions and witness statements; Regarding the summoning the witness and experts to support the claims of the disputing clients.

  • Requirements for appearance and examination of witnesses at hearings

  • Number and timings of hearings and the fees structure have also to be decided.

Resolving the Dispute - After undergoing the above procedure the disputing parties will get access to Resolution Center where they can interact with Arbitrator/Mediator/Opposite Party(s)/Witness/Experts and others if any being administered by the software MEDIATOR AFFAIR

Agreements - Resolutions may be concluded with a decision to be reduced in writing and duly executed with digital signatures of the respective signatures scanned and uploaded to get them enforced.
